It is important that you carefully read these Website Terms of Sale (“Terms of Sale”) before ordering Products through our Website (“Product/s”). Together with our privacy policy and our Terms and Conditions of Use, these Terms of Sale govern the contractual relationship with reference to this Website as well as the purchase of Products made through the same site or by telephone. To accept these Conditions of Sale, please select the box “I have read and accept the conditions of sale” in the Order Confirmation section before placing an order (“Order”). In the event of non-acceptance of these Conditions of Sale, it will be impossible to place orders for Products via the INTERCOM Srl website

These Terms of Sale do not affect your statutory rights, except in the event of conflict with them. In such case, these Terms of Sale prevail over any conflicting rights, provided that this is not in conflict with the provisions of the law.

Who can make purchases?

All adults can purchase through the INTERCOM Srl website.

Warranty

Online orders must be placed in the following ways:

  • When you decide to make a purchase, you must click on “Add to cart” to add the Product to the cart. You must then click on “Proceed to purchase” to enter the reserved section of the site and complete the Order.

  • If this is your first purchase through the INTERCOM Srl website, you will be able to create an account using your email address and a password. You are required to keep your password confidential and not to disclose it by sharing it with third parties. INTERCOM Srl ensures a security procedure for password recovery for subsequent purchases in the event you forget it. You will then be asked to enter your address. The registration address is the one to which the order confirmation will be sent, however it is possible to indicate a different address for delivery.

  • In the case of users already registered, access to the account occurs by entering the registration data.

  • Once you enter the reserved section, any shipping costs are added to the total amount. It is therefore necessary to accept the Conditions of Sale and confirm that you intend to proceed with the Order. You will then be asked to confirm the address and your payment details.

  • Once you have completed the Order, you will be asked to verify its accuracy. If errors are found, it is possible to modify the Order and correct the errors before forwarding it to INTERCOM Srl. It is the user's responsibility to verify the accuracy of the Order before forwarding it. In the event of problems with placing the Order, please contact INTERCOM Srl, at the email address info@essenzadipisa.it or at +39 050 710670.

  • INTERCOM Srl sends a first email confirming receipt of the Order, containing a summary of the sales conditions applicable to the contract, information relating to the main characteristics of the Product as well as detailed information on the price, payment and withdrawal methods, shipping costs and any applicable taxes. The aforementioned email will be sent automatically to the user's registration address.

  • After sending this first email, INTERCOM Srl will verify the possibility of fulfilling the Order, confirming the sending of the Product(s) to the indicated address and providing the user with an estimate of the delivery times. The aforementioned email is automatically sent to the registration address.

  • You are required to verify the accuracy of the email and immediately report any errors to INTERCOM Srl. The Order is considered accepted by INTERCOM Srl at the time of sending the user the email relating to the confirmation of the Order and delivery of the Product, by means of which the contract with INTERCOM Srl is perfected.

  • In the event of problems in placing the Order, an INTERCOM Srl representative will contact the user.


By placing an Order, the user makes an offer to purchase the Product(s) at the price indicated therein.

Prices are checked regularly; however, in the event that INTERCOM Srl detects variations in prices or errors in the indication of the same, it will contact the user asking for confirmation of the intention to proceed with the purchase at the actual price. In the event of confirmation of the purchase, Limarreda Srl will not be under any obligation relating to the delivery of the Product until the Order confirmation email is sent.

If the user finds that he/she has made a mistake in placing the Order, he/she is requested to immediately contact INTERCOM Srl at 0775 61401 or at the email address info@essenzadipisa.it . Please make this report before Limarreda Srl sends the Order confirmation email. INTERCOM Srl is not able to correct Orders after this time, but the user is in any case guaranteed the right of withdrawal as indicated below.

Payment

The prices indicated on the INTERCOM Srl website include VAT, if applicable. Shipping costs are free but may vary based on the delivery address and the applicable VAT may vary depending on the country of destination of the Product.

Prices are subject to change at any time, but such changes will not affect Orders already confirmed in the manner described above.

If the credit card issuer or our service provider refuses or for any reason does not authorize or validate the payment, in such circumstances, INTERCOM Srl shall not be liable for delays or non-delivery with reference to the Products ordered.

Your personal data will be processed by INTERCOM Srl, in accordance with the privacy policy.

Delivery

INTERCOM Srl, while trying to respect the terms indicated in the Delivery Terms section for the delivery of the Product(s) to the indicated address, is not able to indicate an exact delivery date.

In the event that the delivery of the Product(s) does not occur within 30 days of the user placing the Order, or from another date otherwise agreed with the user, the user may withdraw from the Order and INTERCOM Srl will refund the price.

Damaged or defective products

1. Except for specific guarantees offered with reference to particular Products, or guarantees implied by law, INTERCOM Srl does not offer guarantees on its Products.
2. You are required to examine the Products upon receipt to check for any defects or damage. If you find a defect or damage, you are required to inform INTERCOM Srl as soon as possible, which will arrange for the shipment of such Products to its Customer Service Center, at no additional cost to you. Retailers in Italy may accept returns or exchanges of Products; in any case, they will provide useful information to customers intending to return defective or damaged Products. If it is found that a Product was damaged prior to delivery or defective (not due to your use), INTERCOM Srl will repair or replace the Product or will refund the price paid, including any shipping costs, provided that the Product has not been worn or used and damaged. If you would prefer the repair or replacement of the Product, please contact INTERCOM Srl who will arrange for the replacement of the same at no additional cost, where reasonably possible. In addition, INTERCOM Srl will reimburse the costs for returning the defective or damaged Product.

3. Without prejudice to the application of the previous paragraph, INTERCOM Srl is exclusively responsible for losses that are a consequence of violations by INTERCOM Srl of these Conditions of Sale. Such liability is exclusively limited to the purchase price of the purchased Product.

4. Without prejudice to the application of the previous paragraph, INTERCOM Srl shall not be liable for indirect damages which are an indirect consequence of the main damage or loss and which are not foreseeable by the parties, including, but not limited to: INTERCOM Srl shall not be liable for failure, or delay in, the performance of its obligations under these Conditions of Sale resulting from causes beyond its control including: natural disasters, acts of the authorities, war, fire, floods, explosions or insurrections, interruptions of computer or telecommunications services, failure of third parties (including failures relating to the supply of data) and strikes.

  • loss of profits or revenues;
  • loss of job opportunities;
  • loss of profits or contracts;
  • loss of savings


In any case, the clauses of these Conditions of Sale do not imply any limitation of the rights guaranteed by law.

Right of withdrawal

Pursuant to article DL 206/2005, private customers have the right to withdraw from the purchase without the need for any form of explanation, provided that the goods are returned sealed, without damage or missing parts.

Pursuant to paragraph 6, we would like to point out that the only costs owed by the consumer for exercising the right of withdrawal are the costs of returning the goods to the sender.

The deadline for reimbursement is 14 calendar days.

The deadline for exercising this right is 14 calendar days from receipt of the goods, within which the Customer is required to notify us:

Terms and Conditions (important)

In the letter requesting to exercise the right of withdrawal, it is necessary to indicate the details of a bank or postal account to credit the amount due (IBAN code, Account Holder)

In no case will cash on delivery or carriage forward packages be collected. After checking the integrity of the goods, we will refund the amount already paid, no later than 14 days after the goods are returned, via bank transfer to the current account you have provided.

The right of withdrawal, as per current legislation, is applicable exclusively for all standard items that do not have to be made to order by the customer.

Legislative Decree 206/2005

In addition to your right of withdrawal above, Products may be accepted on credit or in exchange if returned to our Customer Service Centre, in a resalable condition, within 14 days of dispatch, accompanied by your packing slip. Such return is at your cost and risk and we encourage you to ensure that the Products are insured during return.

Gift recipients have the right to exchange the goods without refund or to request that the refund be made in favor of the purchaser of the Product.

In the event that payment for the Products is made by prepaid card, refunds will be made by re-crediting the payment to the card on which the charge was originally made.

All refunds will be processed within 14 business days:

  • starting from the email from INTERCOM Srl confirming the cancellation of your Order (in the event that the Products have not been delivered to the address indicated within 30 days following the Order); or from the receipt by INTERCOM Srl of the returned Products.

Some Products may appear slightly larger or smaller than actual size due to screen defects or photographic techniques. Other Products may be shown larger than actual size to clearly show details, or smaller than actual size to show the entire Product.

The exclusivity and uniqueness of our products lies above all in the fact that we offer handcrafted products made with natural materials. Each individual item is worked, completely or partially, by hand and the presence of small defects are a sign of genuineness and uniqueness of the product that guarantee the type of workmanship.

The contract and all communications between you and INTERCOM Srl will be in Italian, English or Spanish where available.

The formation, existence, construction, execution, validity and all aspects relating to these Conditions of Sale are governed by Italian law.

In the event that any of the clauses of these Conditions of Sale are considered null or ineffective, it will be considered non-existent and the remaining part of these Conditions of Sale will remain valid and effective.

Any delay or failure by INTERCOM Srl to exercise any right, faculty or remedy under these Conditions of Sale shall not constitute a waiver thereof, nor shall any single or partial exercise of any such faculty, right or remedy prevent the future or different exercise thereof.
