It is important to carefully read these Website Terms of Sale ("Terms of Sale") before ordering Products through our website ("Product/s"). Together with our privacy policy and our Terms and Conditions of Use, these Terms of Sale govern the contractual relationship with reference to this Website and the purchase of Products made through the same site or by phone. To accept these Terms of Sale, please select the "I have read and accept the terms of sale" box in the Order Confirmation section before submitting an order ("Order"). If you do not accept these Terms of Sale, it will not be possible to place orders for Products through the INTERCOM S.r.l. website.

These Terms of Sale do not affect rights guaranteed by law, except in case of conflict with them. In such cases, these Terms of Sale prevail over any conflicting rights, provided that this does not conflict with legal provisions.

Who can make purchases?

All adults can make purchases through the INTERCOM S.r.l. website.

Warranty

Online Orders must be placed as follows:

When you decide to make a purchase, you must click on "Add to cart" to add the Product to your cart. You then need to click on "Proceed to checkout" to enter the reserved section of the site and complete the Order.

If this is your first purchase made through the INTERCOM S.r.l. website, you can create an account using your email address and a password. You are required to keep the password confidential and not disclose it by sharing it with third parties. INTERCOM S.r.l. ensures a secure password recovery procedure for subsequent purchases if you forget it. You will then be asked to enter your address. The registration address is where the order confirmation will be sent; however, it is possible to indicate a different delivery address.

For already registered users, access to the account is by entering registration data.

Once in the reserved section, any shipping costs are added to the total amount. It is then necessary to accept the Terms of Sale and confirm that you intend to proceed with the Order. You will then be asked to confirm your address and payment details.

Once the Order compilation is complete, you will be asked to verify its correctness. If you find errors, you can modify the Order and correct the errors before submitting it to INTERCOM S.r.l.. It is the user's responsibility to verify the accuracy of the Order before submission. INTERCOM S.r.l. sends a first email confirming receipt of the Order, containing a summary of the terms of sale applicable to the contract, information relating to the main characteristics of the Product, as well as detailed indications relating to the price, payment and withdrawal methods, shipping costs, and any applicable taxes. The aforementioned email will be sent automatically to the user's registration address.

Following the sending of this first email, INTERCOM S.r.l. will verify the possibility of fulfilling the Order, confirming the shipment of the Product(s) to the indicated address and providing the user with an estimate of delivery times. The aforementioned email is automatically sent to the registration address.

You are required to check the accuracy of the email and immediately report any errors to INTERCOM S.r.l.. The Order is considered accepted by INTERCOM S.r.l. at the time of sending the email confirming the Order and the delivery of the Product to the user, by means of which the contract with INTERCOM S.r.l. is finalized.

In case of problems with placing the Order, an INTERCOM S.r.l. representative will contact the user.

By placing an Order, the user makes an offer to purchase the Product(s) at the price indicated therein.

Prices are checked regularly; however, if INTERCOM S.r.l. detects changes in prices or errors in their indication, it will contact the user asking for confirmation of the intention to proceed with the purchase at the actual price.

Payment

The prices indicated on the INTERCOM S.r.l. website include VAT, if applicable. Shipping costs are free but may vary based on the delivery address and the applicable VAT may vary depending on the country of destination of the Product.

Prices are subject to change at any time, but such changes do not affect Orders already confirmed as described above.

If the credit card issuing institution or our service provider refuses or for any reason does not authorize or validate the payment, in such circumstances, INTERCOM S.r.l. is not responsible for delays or non-delivery with reference to the ordered Products.

The user's personal data will be processed by INTERCOM S.r.l., in accordance with the privacy policy.

Delivery

Although INTERCOM S.r.l. tries to respect the terms indicated in the Delivery Terms section for the delivery of the Product(s) to the indicated address, it is unable to indicate an exact delivery date.

In the event that the delivery of the Product(s) does not occur within 30 days from the user's submission of the Order, or from another date otherwise agreed with the user, the user may withdraw from the Order and INTERCOM S.r.l. will refund the price.

Damaged or defective products

1.     Subject to specific guarantees offered with reference to particular Products, or implied guarantees by law, INTERCOM S.r.l. offers no guarantees on its Products.

2.     You are required to examine the Products upon receipt to check for any defects or damage. If you find a defect or damage, you are required to inform INTERCOM S.r.l. as soon as possible, which will arrange for such Products to be sent to its Customer Service Center, without any additional cost on your part. Retailers in Italy may accept returns or exchanges of Products; they will in any case provide useful information to customers intending to return defective or damaged Products. If a Product is found to be damaged prior to delivery or defective (not due to your use), INTERCOM S.r.l. will repair or replace the Product or refund the price paid, including any shipping costs, provided that the Product has not been worn or used and damaged. If you prefer the repair or replacement of the Product, please contact INTERCOM S.r.l. which will replace it at no further cost, where reasonably possible. In addition, INTERCOM S.r.l. will reimburse the costs for returning the defective or damaged Product.

3.     Without prejudice to the application of the preceding paragraph, INTERCOM S.r.l. is exclusively responsible for losses that are a consequence of INTERCOM S.r.l.'s breaches of these Terms of Sale. This liability is exclusively limited to the purchase price of the Product purchased.

4.     Without prejudice to the application of the preceding paragraph, INTERCOM S.r.l. is not responsible for indirect damages that are an indirect consequence of the main damage or loss and that are not foreseeable by the parties, including, but not limited to: INTERCOM S.r.l. is not responsible for the failure, or delay in, the performance of its obligations under these Terms of Sale arising from causes beyond its control including: natural disasters, acts of authority, war, fire, floods, explosions or insurrections, interruptions of IT or telecommunications services, third-party default (including defaults relating to data supply) and strikes.

       loss of profits or revenue;

       loss of business opportunities;

       loss of profit or contracts;

       loss of savings

In any case, the clauses of these Terms of Sale do not limit rights guaranteed by law.

Right of withdrawal

Pursuant to Article, Legislative Decree 206/2005, private customers have the right to withdraw from the purchase without the need for explanations, provided that the goods are returned sealed, without damage or missing parts.

Pursuant to paragraph 6, we point out that the only expenses due by the consumer for exercising the right of withdrawal are the costs of returning the goods to the sender.

The deadline for reimbursement is 14 calendar days.

The useful term to avail oneself of this right is 14 calendar days from the receipt of the goods, within which the Customer is required to notify us by registered letter with return receipt to the address:

Terms and conditions (important)

In the letter requesting to exercise the right of withdrawal, it is necessary to indicate the details of a bank or postal account for the re-crediting of the amount due (IBAN Code, Account Holder).

Packages sent cash on delivery or freight collect will not be accepted under any circumstances. After checking the integrity of the goods, we will re-credit the amount already paid, within and no later than 14 days of returning the goods, by bank transfer to the account you provided.

The right of withdrawal, as per current legislation, is exclusively applicable to all standard items that do not have to be made to customer order.

Legislative Decree 206/2005

In addition to your preceding right of withdrawal, Products may be accepted for credit or exchange if returned to our Customer Service Center, in resalable condition, within 14 days of shipment, accompanied by your delivery note. Such return is at your cost and risk, and we advise you to ensure that the Products are insured during return.

Recipients of a gift have the right to exchange the goods without a refund or to request that the refund be made to the Product's buyer.

If payment for the Products is made using a prepaid card, refunds will be made by re-crediting the payment to the card on which the charge was originally made.

All refunds will be made within 14 business days:

       starting from INTERCOM S.r.l.'s email confirming the cancellation of your Order (in case the Products have not been delivered to the indicated address within 30 days of the Order); or from INTERCOM S.r.l.'s receipt of the returned Products.

Further information

Some Products may appear slightly larger or smaller than their actual size due to screen defects or photographic techniques. Other Products may be represented larger than their actual size to clearly show details, or smaller than their actual size to show the entire Product.

The exclusivity and uniqueness of our products lies primarily in the fact that we offer handcrafted products made with natural materials. Each individual item is processed, completely or in part, by hand, and the presence of small defects are a sign of authenticity and uniqueness of the product that guarantee its type of workmanship.

The contract and all communications between You and INTERCOM S.r.l. will be in Italian, English or Spanish where applicable.

The formation, existence, construction, execution, validity and all aspects relating to these Terms of Sale are governed by Italian law.

If any of the clauses of these Terms of Sale is deemed null or ineffective, it will be considered non-existent and the remaining part of these Terms of Sale will remain valid and effective.

The delay or failure by INTERCOM S.r.l. to exercise any faculty, right or remedy under these Terms of Sale does not constitute a waiver thereof, nor does the single or partial exercise of any of these faculties, rights or remedies prevent the future or different exercise thereof.
