Purpose and Scope of Application
These terms and conditions (hereinafter the “Terms”) govern:

access to and use of the Website;
-
the online purchase of products under the ESSENZA DI PISA brand, including by way of example home fragrance diffusers and handcrafted eau de parfum (hereinafter the “Products”).
Unless otherwise specified, the Terms apply to consumer customers (“Consumers”) and, where compatible, also to professional customers/companies (“Professionals”). Certain protections (e.g., the right of withdrawal) may not apply to Professionals.

Definitions

Customer/User: any person who browses the Website and/or purchases Products.

Consumer: a natural person who purchases for purposes outside their business, trade, craft, or profession.

Order: the purchase proposal submitted by the Customer via checkout.

Contract: the sales agreement concluded between Customer and Seller as set out in Article 6 below.

Product Information
Product descriptions, images, and details (e.g., olfactory notes, sizes, materials, instructions for use) are published on the Website.
Images are for illustrative purposes: colours, finishes, and packaging may vary slightly, including due to artisanal production or availability.
The Customer is required to check warnings, ingredients, instructions for use, and safety information provided on the product page and/or on the label/packaging.
General warnings (indicative)

Home fragrance diffusers: use according to the instructions; avoid contact with eyes/skin and delicate surfaces; keep away from heat sources and out of reach of children/pets.

Eau de Parfum: generally alcohol-based and flammable; avoid contact with eyes and mucous membranes; do not use on irritated skin; discontinue use in case of reaction.

Registration and Account
Registration is optional unless otherwise indicated. The User warrants that the information provided is true and undertakes to keep login credentials secure. The Seller shall not be liable for improper use of the account due to the Customer’s negligence.

Conclusion of the Contract
The Customer selects the Products and completes checkout, accepting these Terms.
Submission of the Order constitutes a contractual offer.
The Contract is deemed concluded when the Seller sends the order confirmation or, alternatively, when the Seller confirms shipment.
The Seller may refuse or cancel the Order in the event of unavailability, obvious errors (e.g., a manifestly incorrect price), suspected fraud, or incomplete/incorrect data; in such cases, any amounts already paid will be refunded.

Prices, Taxes, and Invoicing
Prices are shown on the Website in Euro and may include or exclude VAT depending on what is displayed at checkout (the checkout indication shall prevail).
Shipping costs and any additional charges are shown before the Order is submitted.
Discount codes/promotions apply according to the rules indicated on the Website and may be subject to limitations (expiry, quantity, non-cumulative use).
For an invoice/receipt: the Customer must correctly enter the required details at checkout. The issuance and delivery of fiscal documentation will take place according to the methods indicated at checkout or in the order confirmation.

Payments
Payment methods made available at checkout are accepted (e.g., cards, wallets, bank transfer, etc.).
If a payment is unauthorised or declined, the Order cannot be fulfilled.

Shipping and Delivery
Delivery areas, costs, and estimated delivery times are indicated at checkout and/or in the Website’s shipping section.
Delivery times are estimates and may vary due to causes not attributable to the Seller (e.g., logistics peaks, holidays, strikes, force majeure events).
Upon delivery, the Customer must check the integrity of the package and the conformity of the Products. In the event of visible anomalies, the Customer is advised to accept the delivery “with reservation” (subject to inspection) and to contact the Seller immediately.

Right of Withdrawal (Consumers Only)
The Consumer has the right to withdraw from the Contract within 14 days without providing any reason, starting:

from the day on which the Consumer (or a third party designated by the Consumer) acquires physical possession of the Products.
How to exercise the right of withdrawal
To exercise the right of withdrawal, the Consumer must send an explicit notice within 14 days, stating:
order number, Products to be returned, first name/last name, address, e-mail/phone number.

Return conditions
Products must be returned intact, where possible in the original packaging, complete with any accessories, and without signs of use that would compromise resaleability.
The Consumer bears the direct cost of returning the Products, unless otherwise stated by the Seller.
Exceptions to the right of withdrawal (important)
The right of withdrawal does not apply in cases provided by law, including, by way of example:

sealed goods which are not suitable for return for health protection or hygiene reasons, if unsealed after delivery;
-
goods made to the Consumer’s specifications or clearly personalised.
For perfumes/eau de parfum: if delivered sealed, withdrawal is permitted only if the seal is intact; if the seal is removed and/or the product is used, withdrawal may not apply for hygiene/health reasons.

Refunds
In the event of a valid withdrawal, the Seller shall refund all payments received for the Products subject to withdrawal, including standard delivery costs (where required by law), within 14 days:

from the day the Seller is informed of the decision to withdraw, provided that the Seller may withhold the refund until the Products have been received or until the Consumer has supplied evidence of having sent the return (whichever occurs first).
Refunds will be made using the same payment method used by the Customer, unless otherwise agreed.

Legal Guarantee of Conformity (Consumers Only)
For Products sold to Consumers, the legal guarantee of conformity applies. In the event of a lack of conformity, the Consumer is entitled to the remedies provided by law (restoration of conformity, price reduction, termination, where applicable).
The Consumer is invited to report the issue by contacting the Seller at info@essenzadipisa.com, indicating the order number, a description of the problem, and photos.

Damaged, Incorrect, or Missing Products
If the Customer receives a Product that is:

damaged,
-
different from what was ordered, or
-
missing components,
the Customer must contact the Seller within a reasonable time from delivery, providing evidence (photos/videos) and Order details, to enable the claim to be handled (replacement, refund, etc., as applicable).

Limitation of Liability
To the fullest extent permitted by law:
-
the Seller shall not be liable for delays or service disruptions due to force majeure or third parties (couriers, providers, etc.) beyond the Seller’s control;

the Seller shall not be liable for improper use of the Products contrary to instructions and warnings.
Nothing in these Terms limits the Consumer’s mandatory statutory rights or excludes liability that cannot be excluded by law.

Intellectual Property
Trademarks, logos, texts, images, photographs, design, layout, and Website content are the property of the Seller and/or the respective owners and are protected by applicable laws. Unauthorised reproduction, modification, or use is prohibited.

Privacy and Cookies
Personal data is processed in accordance with the privacy and cookie notice published on the Website (which forms an integral part of these Terms). For privacy requests: info@essenzadipisa.com.

Amendments to the Terms
The Seller may update these Terms. The version applicable is the one in force at the time the Order is placed. Updates will be published on the Website, indicating the “last updated” date.

Governing Law and Jurisdiction
These Terms are governed by Italian law.
For disputes involving Consumers, the competent court is that of the Consumer’s place of residence or domicile, where provided as mandatory. In all other cases, the competent court is that of the Seller’s registered office, unless otherwise provided by law.

Out-of-Court Dispute Resolution (ADR)
The Consumer may use alternative dispute resolution (ADR) mechanisms and consumer assistance channels available at EU/Italian level.
Note: the European ODR platform for online disputes is indicated as discontinued as of 20 July 2025 according to institutional communications; other forms of ADR and consumer assistance remain available.
